Welcome to Creeds Design. By accessing our website (creedsdesign.com) or purchasing any of our services, you agree to be fully bound by the following terms and conditions. Please read them carefully before engaging our services.

Governing Law & Jurisdiction

These terms shall be governed by and construed in accordance with the laws of the State of Utah. Any legal action, suit, or proceeding arising out of or relating to these terms shall be instituted exclusively in the courts of Davis County, Utah.

Absolute Limitation of Liability CRITICAL

To the maximum extent permitted by applicable law, the Client agrees that the total aggregate liability of Creeds Design, its owner, and its contractors for any and all claims, losses, costs, or damages shall not exceed the total amount actually paid by the Client for the specific project or service. This cap applies regardless of the cause of action, whether in contract, tort (including negligence), or otherwise.

Right of Termination

Creeds Design reserves the right to terminate any project or service agreement at any time for any reason.

  • If the Company terminates a project for its own convenience, a prorated refund for unearned fees will be issued.
  • If the Company terminates due to a breach by the Client (e.g., failure to provide assets or persistent lack of communication), the Company may retain all fees paid to date as liquidated damages.

Force Majeure (Unforeseeable Events)

Creeds Design shall not be held liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to:

  • Acts of God, strikes, or supply chain disruptions.
  • Third-party API failures, internet outages, or AI model “hallucinations” and errors.
  • Changes in telecommunications regulations affecting AI receptionist services.

No Consequential Damages

Under no circumstances shall Creeds Design be liable for any indirect, incidental, or consequential damages, including but not limited to loss of business profits, revenue, data, or anticipated savings.

Refund Policy & Dispute Resolution

In the event that Creeds Design determines it cannot fully deliver on the promised project or services, the Company may, at its sole discretion, offer a partial or full refund of the fees paid for that specific project.

  • The issuance of such a refund constitutes a full and final settlement of all potential claims by the Client.
  • Acceptance of a refund by the Client acts as a complete release of the Company and its owner from any further liability, demands, or legal action.
